Terms of Service — KolayVignet
In short. Through KolayVignet you buy an e-vignette for your trip; we handle the purchase with the official authority and e-mail you the confirmation. By completing your order you agree to these terms.

Article 1 — Identity of the seller
KolayVignet is a trade name / service of:

In these terms we are referred to as "KolayVignet", "we" or "us". You, the customer, are referred to as "you" or "the customer".
Article 2 — What we do (description of the service)

KolayVignet is an intermediary and execution service. For a processing fee, we purchase the official electronic vignette (e-vignette / digital toll sticker) on your behalf on the official website of the relevant government or toll operator. We currently support vignettes for, among others, Austria (ASFINAG), Hungary, Czechia, Bulgaria and Slovakia.

We are expressly NOT a government authority, NOT a toll operator and NOT affiliated with them. We do not sell you our own vignette and we are not an official point of sale. We perform a service for you: placing the official order in your place, entering your data and handling the payment on the official site.

The vignette itself is issued by the relevant official authority. The validity, the conditions and the scope of the vignette are determined exclusively by that authority and by the legislation of the relevant country. We have no influence over this.

For our service you pay, in addition to the official vignette price, a separate processing/service fee (see Article 4). This fee is the consideration for the convenience, the automated handling and the delivery of the official document.
Article 3 — Formation of the agreement

You place an order via our website by entering the destination country, the validity period and your vehicle details (licence plate and, where the country requires it, the VIN).

Before completing the order, you see a clear overview showing the official vignette price, our processing fee and the total amount.

The agreement is formed at the moment you confirm the order, start the payment, and we accept your order. You then receive a confirmation by e-mail.

By confirming the order you declare that you have read and accepted these Terms of Service and that the data you have entered is correct and complete.

The language of the agreement is Dutch. If a translation of these terms is available and there is any discrepancy, the Dutch text prevails, subject to the mandatory law of your country of residence.
Article 4 — Prices and processing fee

The total price consists of:
- (a) the official vignette price, as applicable on the official site at the time of purchase; and
- (b) our processing/service fee (indicative price approximately EUR 2; the exact amount is clearly shown before payment).

All prices are shown before payment in euros and including the applicable costs. There are no hidden costs.

The official vignette price may be changed by the relevant authority. The price that applies on the official site at the time of purchase, and that you see in the order overview, is decisive.
Article 5 — Payment

Payment is processed via our payment service provider Stripe (Stripe Payments Europe, Ltd.). We do not ourselves process full card details; these are handled directly and securely by Stripe.

The full total price (vignette price + processing fee) is charged at the time of the order.

We only start purchasing the official vignette after your payment has been confirmed.
Article 6 — Delivery

Delivery is fully digital and takes place by e-mail to the e-mail address you provide.

You receive:
- (a) an order confirmation, and
- (b) the official vignette document / confirmation (PDF) as soon as this is issued by the official authority.

Delivery time: in most cases delivery takes place within a few minutes. For some countries the official document is issued by the authority itself by e-mail; this may take longer (as a rule up to a few hours, depending on the relevant authority). The stated periods are indicative and are not strict deadlines.

Always check your spam / junk mail folder as well. If you have received nothing after the stated period, please contact us at destek@kolayvignet.com.

It is your responsibility to provide a correct and reachable e-mail address. We are not liable for non-delivery resulting from an incorrectly provided e-mail address.
Article 7 — Express consent and waiver of the right of withdrawal (IMPORTANT)

Distance contracts with consumers are, in principle, subject to a statutory 14-day right of withdrawal (cooling-off period).

The purchase of an official vignette is carried out by us immediately after your order and payment and is instant and final: once the vignette has been registered in the name of your licence plate with the official authority, the purchase can no longer be undone or reversed.

For this reason, when you place the order we ask you, by means of a separate, actively ticked checkbox (i.e. not merely by accepting these terms), to provide:
- (a) your express prior request and consent that we begin performing the service immediately, still within the statutory cooling-off period; and
- (b) your express acknowledgement that you lose your right of withdrawal once the service has been fully performed by us.

Because the service is, at your request, fully performed before the end of the cooling-off period, you lose your right of withdrawal (the 14-day cooling-off period) once the service has been fully performed — that is, once the vignette has been registered with the official authority and/or the official document has been delivered to you.

This waiver is in accordance with Article 16(a) of the EU Consumer Rights Directive (2011/83/EU) and the corresponding national legislation (in the Netherlands, Article 6:230p(d) of the Dutch Civil Code). You actively confirm the request and the acknowledgement under paragraph 3 before payment; we record this confirmation on a durable medium (for example, the order confirmation by e-mail).

Consequence: once performance has been fully completed, you no longer have a right of withdrawal or refund, except in the cases set out in Article 8 (failed purchase) and except for your mandatory statutory rights. If you have validly exercised a right of withdrawal before performance was fully completed, you owe a proportionate amount for the part of the service performed up to that point.
Article 8 — If the purchase fails (refund / remedy)

We depend on the official vignette sites for performance. It may happen that a purchase does not (fully) come about, for example due to a malfunction, a rejection, or unavailability of the official site.

If we are unable to deliver the official vignette, then:
- (a) we will first arrange delivery as soon as possible after all (remedy), or
- (b) if delivery turns out not to be possible, we will refund you the full amount you paid for the undelivered vignette, including the processing fee for that vignette.

If a vignette has been validly purchased and registered, but an error has arisen because you provided incorrect data (for example a wrong licence plate), the purchase can, as a rule, not be remedied or refunded free of charge; see Article 9. We will make an effort to help you, to the extent the official authority allows.

Refunds are made via the same payment method (Stripe) used for payment, at no cost to you.
Article 9 — Your obligations as a customer

You are responsible for providing all data required for the purchase correctly, completely and on time, including in any event:
- the correct licence plate (exactly as on your vehicle registration document);
- where required, the correct VIN (vehicle identification number);
- the correct validity period and the correct country;
- a correct e-mail address.

Because the vignette is registered by the official authority directly to the licence plate you provide and this registration cannot be reversed, the consequences of incorrect data are at your expense. Therefore check your data carefully before confirming.

You warrant that you are entitled to obtain a vignette for the vehicle specified.

You are yourself responsible for checking whether the vignette is valid for your route, vehicle category and travel period, and for ordering it before the start of your journey on the toll roads.
Article 10 — Liability and limitations

We perform our service to the best of our ability and with due care. However, our service is an execution service that depends on the official, external vignette sites and authorities over which we have no control.

We are not liable for:
- malfunctions, errors, delays or price changes at the official authorities or payment service providers;
- the validity, scope or conditions of the vignette issued by the official authority;
- fines, additional charges or other damage resulting from data you provided incorrectly, from ordering too late, or from driving without a valid vignette;
- damage caused by not (timely) receiving e-mail as a result of an incorrect e-mail address or spam filters on your side;
- force majeure.

To the extent that we are liable, our liability is limited to the amount you paid for the relevant order (vignette price + processing fee), except in the case of intent or deliberate recklessness on our part and except for mandatory statutory liability (such as for death, personal injury or mandatory consumer protection).

Nothing in these terms limits or excludes your mandatory statutory rights as a consumer.
Article 11 — Personal data

To perform the service, we process personal data, in particular your e-mail address, your licence plate and, where a country requires it, the VIN.

This data is shared with the following recipients/processors, only to the extent necessary to perform your order:
- Stripe — for payment processing;
- the official vignette sites/authorities — to register the vignette to your licence plate;
- our e-mail provider — for sending confirmations and documents.

Article 12 — Complaints and support

We aim to respond substantively within a reasonable period, usually within a few business days.

If we cannot resolve the matter together, as an EU consumer you may also submit your dispute via the ODR platform of the European Commission: https://ec.europa.eu/consumers/odr.
Article 13 — Applicable law and competent court

This agreement and these terms are governed by Dutch law.

Disputes are submitted to the competent court in Rotterdam, without prejudice to your mandatory right as a consumer to submit the dispute to the court of your place of residence or another court that is competent under mandatory law.
Article 14 — Final provisions

Amendments. We may amend these Terms of Service. The version that applied at the moment the agreement was formed always applies to your order.

Partial invalidity. If a provision of these terms is null or voidable, the remaining provisions remain in force. The parties will replace the relevant provision with a valid provision that approximates its intent as closely as possible.

Entire agreement. These terms, together with the order overview and the confirmation, constitute the entire agreement between you and us with respect to the service ordered.
